Terms of service
These terms govern access to musayda's website and SaaS platform by real estate agencies and authorized users.
1. Agreement
By accessing musayda.com or using the musayda Client Portal, you agree to these Terms of Service and our Privacy Policy. If you use musayda on behalf of an agency, you represent that you have authority to bind that organization.
2. Service description
musayda provides a multi-tenant software platform for lead capture, AI-powered buyer qualification, unified messaging, property inventory, calendar scheduling, ads intelligence, and related features for real estate agencies. Features vary by subscription plan.
3. Accounts & eligibility
- Agencies receive accounts through musayda onboarding or platform administrators
- You must provide accurate registration information and keep credentials secure
- You are responsible for all activity under your account and authorized users
4. Acceptable use
You agree not to:
- Use musayda for unlawful, deceptive, or spam messaging
- Attempt to access other tenants' data or bypass security controls
- Reverse engineer, scrape, or overload the platform
- Connect channels without proper authorization from Meta, Google, or other providers
- Use AI outputs as legal, financial, or regulatory advice without human review
5. Agency responsibilities
Agencies are responsible for:
- Obtaining consents required to message buyers on WhatsApp, social, and other channels
- Accuracy of property listings and agency knowledge base content
- Broker conduct when taking over AI conversations
- Compliance with UAE, GCC, and applicable data protection laws
6. Subscription & billing
Plans (Starter, Growth, Enterprise, Custom) include usage limits for leads, AI replies, and broker seats. Overages, upgrades, and payment terms are defined in your order form or agreement. Unless otherwise stated, subscriptions renew automatically.
7. AI disclaimer
musayda uses large language models to qualify buyers and draft replies. AI may produce inaccurate outputs. Agencies should review high-value interactions and configure AI behavior appropriate to their market and compliance requirements.
8. Intellectual property
musayda retains all rights in the platform, brand, and documentation. Agencies retain ownership of their listings, buyer data, and uploaded content. You grant musayda a limited license to process content solely to provide the service.
9. Availability & support
We strive for high availability but do not guarantee uninterrupted service. Maintenance, third-party API outages (Meta, WhatsApp, etc.), and force majeure may affect availability. Support levels depend on your plan.
10. Limitation of liability
To the maximum extent permitted by law, musayda is not liable for indirect, incidental, or consequential damages, lost profits, or lost leads arising from use of the service. Our aggregate liability is limited to fees paid in the twelve months preceding the claim.
11. Termination
Either party may terminate per agreement terms. We may suspend access for material breach or non-payment. Upon termination, access ends and data export/deletion follows contractual and legal requirements.
12. Governing law
These terms are governed by the laws of the United Arab Emirates unless otherwise agreed in writing. Disputes shall be resolved in the courts of Dubai, UAE.
